Fall 2025 | Issue 3
This Fall 2025 | 3rd edition of the CADR Newsletter gives a brief overview of important domestic and international ADR developments.
Domestically, the Supreme Court clarified that the COVID-19 exclusion period applies to limitation calculations for Section 11 applications in the Offshore-BPCL case, affirming that an invalid arbitrator appointment clause does not negate the fundamental intent to arbitrate. The MSMED Act does not have jurisdiction over complex "works contracts," according to the Orissa High Court, which invalidated an MSME award. The Delhi High Court ruled that an unregistered agreement to sell for a property in Uttar Pradesh is unenforceable, upholding an arbitral termination. Over 5,500 cases were successfully resolved through mediation during a special 90-day drive in Karnataka, greatly lowering the number of pending cases.
Commercial arbitration awards and high-stakes investments made headlines, globally.
Investors from the Middle East threatened Pakistan with an OIC arbitration claim for US$2 billion over the K-Electric utility. By rejecting its last appeal, the Dutch Supreme Court put a definitive end to Russia's ten-year challenge to the US$65 billion Yukos awards. An ICSID tribunal upheld the state's "essential security interests" defense in relation to a plantation seizure during civil unrest, rejecting a US$286 million DR-CAFTA claim against Nicaragua.
The Paris Court of Appeal enforced a US$22 million ICC award for Georgia, and the UK Supreme Court upheld Nigeria's £20 million costs order against P&ID in enforcement actions.
Technology and international collaboration were the main topics of industry gatherings. The American Arbitration Association (AAA) unveiled its "AAAi" AI-powered mediator search tool, and China and Singapore signed a joint declaration to strengthen their cooperation in dispute resolution. Artificial Intelligence (AI) emerged as a major theme in ADR at both the EUIPO IP Mediation Conference in Malta and Australian Arbitration Week in Sydney.

Fall 2025 | Issue 2
This Fall 2025 | Issue 2 edition of the CADR NEWSLETTER gives a brief overview of important ADR developments. Domestically, the Supreme Court handed down key decisions: in the SEPCO-GMR debacle, it confirmed the setting aside of a $995 Crore arbitral award, holding the tribunal transgressed its jurisdiction by revising the contract's "No Oral Modification" clauses. The Court also confirmed party autonomy over interest, and held that an expressly stipulated rate in the award precludes further post-award compound interest, and clarified that the sole pendency of an appeal does not ipso facto suspend the enforcement of an award.

The Karnataka High Court reaffirmed kompetenz-kompetenz, and held that a procedural rule amendment is not enough to thwart the underlying arbitration agreement.
Globally, it was all about Investment Treaty Arbitration (ITA). Tribunals dismissed significant UNCITRAL claims against India (2G Spectrum Scandal) and Ecuador (casino investor) on grounds of "investor" definition and jurisdiction, respectively.
The UK Court rejected Mongolia's sweeping disclosure application in the Rio Tinto Oyu Tolgoi arbitration, while Egypt suggested international arbitration for new GERD dispute with Ethiopia. Industry events such as India ADR Week and the ICC New York Conference identified new concerns such as Artificial Intelligence in dispute resolution.

We are very excited to present the inaugural issue of the CADR Newsletter, an organized overview of the most important developments in arbitration and alternate dispute resolution from India and around the world.

This issue includes notable Supreme Court and High Court decisions of great significance to the arbitration landscape, including the courts determination that unsigned contracts can sometimes exist with binding impact if the parties' conduct demonstrates acceptance, and that clauses providing for "no-interest" do not prevent pendente lite interest from accruing, as well as the Delhi High Court's emphasis on institutional autonomy under the SAROD Rules.

The Calcutta High Court has also articulated the notion that it is reasonable for executing courts to exercise discretion in balancing equity when modifying stay orders. ​

We are also able to share international highlights relating to the Singapore International Arbitration Centre's first in the world Restructuring and Insolvency Arbitration Protocol, the ICSID annulment decision confirming a US$76 million award against Georgia, the suspension of a US$24 million ICSID claim against the US filed by Ukrainian oligarchs, and Chile's settlement of its 5G rollout dispute with WOM.
